Requesting Remote Oral Argument Policy

To best serve our court users while maintaining optimal court efficiency, the court has implemented the following protocols for remote oral argument via Zoom. 

  • Jointly AND timely filed motions for remote argument will be granted by the court.  If the request is jointly made, parties do not have to state any reason for the request.

     

  • Timeliness: To be deemed timely, the motion for remote oral argument in lieu of in-person oral argument must be filed no later than 10 days after the appellee’s brief is filed.

     

  • Opposed: If not filed jointly, the party filing a motion for remote oral argument must detail the reasons for remote oral argument in lieu of in-person oral argument.  The court will consider motions for remote oral argument for “good cause” shown.  Any opposition must be filed within 10 days after service of the motion.  If no opposition is filed, the court will treat the motion as a joint request.

     

  • Untimely Motions: Absent an emergency, the court will not consider untimely motions for remote argument.  Any motion, joint or otherwise, must be filed no later than 10 days after the appellee’s brief is filed. Cases already assigned for in person oral argument between February 14, 2022 and March 11, 2022 will proceed in person unless otherwise ordered by the Court.

* Remote Arguments Due To COVID-Related Concerns: Apart from the protocols above, the court will accommodate remote argument for any COVID-related health concern.  Parties are asked that they notify the court as soon as possible but, absent an emergency, not less than 14 days before the hearing.
